Terms of Service

1. Acceptance of Terms
By creating an account or using MaskotIA (the "Service"), operated from Mexico by MaskotIA (the "Operator"), you agree to these Terms of Service. If you do not agree with any of the terms, do not use the Service.
Continued use of the Service after any modification of these Terms constitutes your acceptance of the revised version.
2. Description of the Service
MaskotIA is a Software-as-a-Service (SaaS) platform that provides:
• Digital clinical documentation tools for veterinarians, including AI-assisted SOAP notes.
• A digital pet health card, QR identity tag and proactive health reminders for pet owners.
• Telemedicine video consultations between pet owners and veterinary clinics.
• A marketplace for pet-related products sold by clinics and registered independent sellers.
• A marketplace for pet-care services (dog walkers, pet sitters) provided by independent third parties.
• Adoption listings, lost-pet alerts, and a community feed.
AI features (clinical assistance, symptom triage, suggested medications) are informational only and do not replace the professional judgment of a licensed veterinarian.
3. Eligibility
You must be at least 18 years old to create an account. Professional accounts (Básico, Profesional, Clínica) must be held by a licensed veterinarian or by an organization that employs licensed veterinarians.
4. Account Registration and Security
You agree to provide accurate, current and complete information when registering and to keep your password confidential. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.
5. Plans, Free Trials and Billing
MaskotIA offers four recurring subscription plans (Básico, Profesional, Clínica, Protector), an optional marketplace module, and a custom Multi-branch plan negotiated directly.
• Every paid subscription plan includes a 60-day (2-month) free trial with access to all features. No charge is made during the trial period.
• Subscriptions renew automatically at the end of each billing cycle (monthly or annual) until you cancel.
• Subscription prices are shown in U.S. dollars (USD), excluding taxes. Marketplace products and caregiver services may be priced in the seller's or caregiver's local currency (USD, MXN, ARS, COP, BRL, CLP, PEN). Applicable taxes (VAT, IVA, sales tax) are added at checkout according to the buyer's country.
• Payments are processed by a PCI-DSS-certified third-party payment processor. MaskotIA does not store card numbers.
• Platform commissions: 10% on marketplace product sales; 15% on caregiver services; 5% on clinic online payments (15% only on the first payment of a new patient referred by MaskotIA).
6. Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current paid period; you retain access until then. See our Refund Policy for further details.
7. Acceptable Use
You agree not to use the Service for:
• Any unlawful or unauthorized purpose.
• Uploading content that infringes intellectual property or privacy rights of third parties.
• Attempting to reverse-engineer, decompile or otherwise extract source code.
• Using automated tools (scrapers, bots) to extract data from the Service without authorization.
• Reselling, sublicensing or redistributing the Service without prior written permission.
• Uploading defamatory, obscene content or content that promotes animal harm.
8. Veterinary Information Disclaimer
MaskotIA's AI tools are designed to assist licensed veterinary professionals and to offer general guidance to pet owners. AI-generated suggestions DO NOT replace an in-person clinical examination, a diagnosis or professional veterinary treatment.
In case of a medical emergency involving your pet, contact a local veterinarian immediately. The Operator is not responsible for clinical decisions taken solely on the basis of AI suggestions.
8-A. Telemedicine (Video Consultations)
Video consultations connect pet owners with clinics and veterinarians registered on the platform. The professional veterinarian-client relationship is established between the owner and the veterinarian; MaskotIA acts solely as a technology facilitator and charges a per-transaction commission.
A video consultation DOES NOT replace an in-person physical examination. The veterinarian may determine that the case requires in-person or emergency care, and the owner is responsible for following that instruction. Do not use telemedicine for emergencies: go to a physical clinic immediately.
The availability, diagnostic quality and outcome of a video consultation are the responsibility of the professional providing it. The Operator does not guarantee diagnoses or clinical outcomes.
8-B. Caregiver and Dog-Walker Marketplace
Caregivers and dog walkers offering services on MaskotIA are independent contractors; they are NOT employees, agents or representatives of the Operator. MaskotIA acts as a technology intermediary: it facilitates the connection, the held payment and its release upon service completion, retaining a 15% commission.
The Operator does not supervise service delivery and does not guarantee the suitability, conduct or results of caregivers. The owner is responsible for reviewing the caregiver's profile, reviews and experience before booking, and for providing accurate information about their pet (health, behavior, special needs).
Booking cancellation policy: more than 24 hours in advance, full refund; between 2 and 24 hours, 50%; less than 2 hours or no-show, no refund. If the caregiver cancels, the owner receives a full refund.
Any dispute regarding harm to the pet or property during a service must be reported to the Operator within 72 hours; the Operator will facilitate communication between the parties, without thereby assuming responsibility for the service provided.
8-C. Adoptions
The adoptions module allows users and clinics to list pets for adoption and interested parties to contact them. MaskotIA does NOT verify the health status, temperament or origin of listed animals, nor the suitability of adopters. The parties are responsible for performing their own checks and for complying with local legislation on animal ownership and transport.
Using the adoptions module for disguised animal sales or any undeclared commercial breeding activity is prohibited.
9. Intellectual Property
All MaskotIA software, trademarks, logos, design and content are the exclusive property of the Operator or its licensors. Users retain ownership of their own clinical records, pet data and uploaded files.
By using the Service, you grant the Operator a limited, worldwide and royalty-free license to host, display and process your content to the extent necessary to provide the Service.
10. Termination
We may suspend or terminate your account if you breach these Terms, if continued use poses a legal or technical risk to the Service, or if your subscription remains unpaid after the grace period. We will give at least 7 days' notice when reasonably possible.
Upon termination, you may export your data for 30 days. After that period, the data may be permanently deleted.
11. Limitation of Liability
To the maximum extent permitted by applicable law, the Operator will not be liable for indirect, incidental, special or consequential damages arising from use or inability to use the Service. Our total cumulative liability to you is limited to the amount paid by you to the Operator during the twelve (12) months prior to the event giving rise to the claim.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Mexican States. Any dispute will be submitted to the competent courts of Mexico City, Mexico.
However, if you reside in another Latin American country, NOTHING in these Terms limits the non-waivable rights granted to you by the consumer-protection legislation of your country of residence. Where such legislation requires it, you may bring actions before the courts or consumer authorities of your own country (for example, PROFECO in Mexico, SERNAC in Chile, SIC in Colombia, Procon in Brazil, Indecopi in Peru, or the Consumer Protection authority in Argentina), and the mandatory rules of that jurisdiction will prevail over these Terms to the extent they are more favorable to you.
12-A. Right of Withdrawal and Payment Reversal
Colombia (Consumer Statute, Law 1480 of 2011, art. 47): if you are a consumer, you have a right of withdrawal in distance and electronic sales, which you may exercise within five (5) business days following the conclusion of the contract. Once withdrawal is exercised, we will refund your money without deductions within a maximum of thirty (30) calendar days.
Colombia (art. 51): in electronic commerce you may also request a payment reversal when you are a victim of fraud, when the transaction was not requested, or when the service is not provided; we will process the request with the payment provider in accordance with the law.
Mexico (Federal Consumer Protection Law): we respect the non-waivable rights the LFPC grants consumers, including clear information on prices and conditions before contracting and the ability to cancel in accordance with applicable law.
To exercise any of these rights write to soporte@maskotia.com within the period applicable to your country. These rights apply independently of the 30-day commercial guarantee we offer on annual plans (whichever is more favorable to you prevails).
13. Changes to these Terms
We may update these Terms from time to time to reflect changes in the Service, in applicable law or in our business practices. Material changes will be announced by email or within the application at least 14 days before they take effect.
